Purpose and basis for the processing of personal data

The legal basis for our processing is:

  • Art. Article 6(1) Article 1(a) of the General Data Protection Regulation, i.e. your consent to receive information about the e-mail you sent to us;
  • Art. Article 6(1) Article 1(b) of the General Data Protection Regulation, i.e. processing is necessary for the performance of a contract to which the data subject is party or to take steps at the request of the data subject prior to entering into a contract.
  • Art. Article 6(1) Article 1(c) of the General Data Protection Regulation, i.e. processing is necessary for compliance with a legal obligation to which the Controller is subject, i.e. ensuring the Controller’s compliance with the applicable financial, accounting and tax regulations; performance of concluded entrustment agreements;
  • Art. Article 6(1) Article 1(f) of the General Data Protection Regulation, i.e. processing is necessary for the purposes of the legitimate interests pursued by the Controller, i.e. communicate about the performance of the contract; to establish, exercise and/or defend possible legal claims; supplier assessments.
  • In the case of persons designated for contact under the contracts, we would like to inform you that we have obtained personal data from persons representing the entity and process such categories of personal data as: names and surnames, e-mail addresses, telephone numbers.

Revocation of consent

You can withdraw your consent at any time by sending an e-mail to: rodo@wuzetem.pl Exercising the right to withdraw consent does not affect the processing that took place up to the time of withdrawal.

Duration of data storage

Personal data will be stored until the contract is performed; until the expiry of the obligations resulting from the applicable provisions of financial, accounting and tax law; until the execution of the entrustment agreements; until legal claims are established, pursued and/or defended; until you revoke your consent.

Data Sharing

In addition to the Administrator’s employees or associates, on the basis of the concluded agreement, your personal data may be made available or entrusted by the Administrator for processing also to external entities supporting the Administrator in its day-to-day operations, in particular:

  • entities providing accounting and HR services to the Administrator, including HR and payroll, accounting and tax services, etc., in particular to the extent necessary to perform accounting or settlement activities related to the performance of the agreement;
  • entities providing legal services to the Administrator, including those providing ongoing legal services to the Administrator, to the extent necessary to provide such services, including those related to m.in. determining, pursuing or recovering claims or obligations, including those arising from contracts or generally applicable law;
  • entities providing administrative services to the Administrator related to its day-to-day operations, m.in. in the field of ICT and IT services, including maintenance and maintenance of IT systems used by the Administrator, in which personal data are stored;
  • entities providing postal or courier services to the Administrator, to the extent that the use of the above-mentioned services will take place on the occasion of or in connection with the performance of contracts;
  • economic information bureaus (the so-called “credit bureaus”) to the extent necessary to check the condition and financial and economic credibility of the data subject or the entity represented by him/her, before concluding the agreement or during its performance, in particular checking the entities in the debtors’ registers.

Rights of data subjects

At any time, you have the right to access your data, rectify it, delete it, limit its processing, transfer your data and to object to further processing. You have the right to lodge a complaint with the President of the Personal Data Protection Office.

Profiling

The Administrator informs that the data provided by you will not be subject to profiling.

The legal basis for the processing of personal data is:

  • Art. Article 6(1) Article 1(a) of the General Data Protection Regulation, i.e. unambiguous and voluntary consent of the person whose data we will process, either in the form of an e-mail/inquiry sent to us or in the form of an unchecked checkbox;
  • Art. Article 6(1) Article 1(c) of the General Data Protection Regulation, i.e. processing is necessary for compliance with a legal obligation to which the controller is subject – Art. 10 of the Act on the Provision of Electronic Services;
  • Art. Article 6(1) Article 1(f) of the General Data Protection Regulation, i.e. processing is necessary for the purposes of the legitimate interests pursued by the Controller, i.e. to establish, exercise and/or defend legal claims.

Revocation of consent

Providing data is voluntary, but necessary to receive information/commercial offers, to determine or pursue and/or defend claims. If you do not provide the data, it will not be possible to send you information/commercial offers. You can withdraw your consent at any time by sending a request to: rodo@wuzetem.pl Exercising the right to withdraw consent does not affect the processing that has taken place up to the time of withdrawal.

Data Sharing

Personal data may be made available to entities based on the provisions of law, as well as entities providing services to WUZETEM:

  • entities providing legal services to the Administrator, including those providing ongoing legal services to the Administrator, to the extent necessary to provide such services, including those related to m.in. determining, pursuing or collecting claims or obligations, including those arising from the provisions of generally applicable law;
  • entities providing administrative services to the Administrator related to its day-to-day operations, m.in. in the field of ICT and IT services, including maintenance and maintenance of IT systems used by the Administrator, in which personal data are stored;
  • entities providing postal or courier services to the Administrator;
  • business information bureaus (so-called “credit bureaus”) to the extent necessary to check the condition and financial and economic credibility of the data subject or the entity represented by him/her, before concluding the agreement or during its performance, in particular checking the above-mentioned entities in the registers of debtors, if the contact with a potential client is aimed at signing a contract.

  • Your consent to the use of your data for the purpose of future recruitment – Art. Article 6(a) of the General Data Protection Regulation;
  • Exercising a right or fulfilling an obligation resulting from a provision of law for data other than those contained in Art. 221 § 1 of the Labour Code;
  • Personal data will be processed for the purpose of carrying out the current recruitment process, including receiving information by e-mail/phone, as well as if you have given your consent to be contacted and participate in future recruitment processes.

Your personal data collected during the recruitment process will be stored until the end of the recruitment process. If you agree to the use of your data for the purpose of participating in future recruitments, your data will be processed for a period of 12 months.

  • The provision of data is a statutory obligation in accordance with Art. 221 § 1 of the Labour Code, providing data is necessary to carry out the recruitment process, as well as to receive electronic and/or telephone information related to the recruitment process. In the absence of data in accordance with Article 221 § 1 of the Labour Code, it will not be possible to carry out the recruitment process, as well as to provide electronic and/or telephone information regarding the recruitment process;
  • Provision of data other than those contained in Art. 221 § 1 of the Labour Code, including special category data referred to in Article Article 9(1) Article 1 of the General Data Protection Regulation is voluntary. If you do not provide this data, it will be possible to carry out the recruitment process on the basis of your data in accordance with Art. 221 § 1 of the Labour Code;
  • Consent to future recruitment is voluntary, but if you do not give your consent, we will not process your m.in. to invite you to participate in future recruitments.

Purposes of processing/legal basis

  • Your personal data will be processed for the purpose of performing tasks in the scope of providing services to natural persons purchasing shares of Warszawskie Zakłady Mechaniczne “PZL – WZM” w Warszawie S.A., resulting from the provisions of law specified in the Code of Commercial Companies (in particular, Article 341, i.e. entry in the Share Register and its maintenance; Article 406, i.e. enabling you to participate in the General Meeting of Shareholders; Article 407, i.e. drawing up a list of shareholders entitled to participate in the General Meeting and displaying it at the Management Board’s premises for three working days prior to the General Meeting, in order to make it available to other Shareholders, make copies and send them to other Shareholders; Article 410, i.e. drawing up an attendance list containing a list of participants of the General Meeting of Shareholders, in the case of your participation in the General Meeting of Shareholders);
  • In addition, the legal basis for the processing of your data may be Art. Article 6(1) Article 1(f) of the General Data Protection Regulation, i.e. the legitimate interest pursued by the Administrator consisting in the appropriate protection of information in the event of the need to indicate evidence, ensuring the possibility of contact, handling correspondence and circulation of documents or possibly establishing, pursuing and/or defending against claims.

Recipients of the data

Your personal data may be entrusted by the Administrator for processing also to external entities supporting the Administrator in its day-to-day operations, in particular:

  • entities providing accounting and HR services to the Administrator, including HR and payroll, accounting and tax services, etc., in particular to the extent necessary to perform accounting or settlement activities;
  • entities providing legal services to the Administrator, including those providing ongoing legal services to the Administrator, to the extent necessary to provide such services, including those related to m.in. with the determination, investigation or recovery of claims or those resulting from the provisions of generally applicable law;

  • entities providing postal or courier services to the Administrator.

Retention period

Personal data will be stored until the purposes of providing services to natural persons purchasing shares of Warszawskie Zakłady Mechaniczne “PZL – WZM” w Warszawie S.A. resulting from the provisions of the Commercial Companies Code cease to exist, as well as until the information is adequately secured in the event of the need to indicate evidence, ensure the possibility of contact, handle correspondence and circulation of documents, or possibly establish, pursue and/or defend against claims.

Purpose and basis for the processing of personal data

The legal basis for the processing of your data is:

  • Art. Article 6(1) Article 1(b) of the General Data Protection Regulation, i.e. Your cooperation in the performance of work for the Warsaw Mechanical Works “PZL-WZM” in Warsaw S.A., in connection with the concluded, performed or terminated employment contract.
  • Art. Article 6(1) Article 1(c) of the General Data Protection Regulation, i.e. fulfilling the legal obligations incumbent on the Warsaw Mechanical Works “PZL-WZM” in Warsaw S.A. in connection with the employment of employees, among others, on the basis of the provisions of the labour law, provisions on social insurance, health insurance, taxes, accounting, the Archives Act, but also other obligations resulting from legal regulations and concluded entrustment agreements.
  • Art. 6 List (f) of the General Data Protection Regulation, i.e. the legitimate purpose of the controller in the field of establishing, pursuing and/or defending claims; within the scope of continuous and uninterrupted conduct of operations by Warszawskie Zakłady Mechaniczne “PZL-WZM” w Warszawie S.A. by making and ensuring the integrity, confidentiality and availability of data copies.
  • Art. Article 6(1) 1 letter a) your consent to place your name and position under the article in the employee’s internal newspaper, which is distributed only within the Company for employees/associates. This consent is given by your initiative in the inclusion of this data.
  • Art. Article 9(1) Article 2(h) of the General Data Protection Regulation, i.e. for the purposes of preventive health care and occupational medicine, to assess the employee’s ability to work.

Duration of data storage

Your personal data will be stored for the period of employment (performance of an employment contract) and then for the period indicated by the provisions of the labour law and other special regulations, m.in. the Accounting Act, the Tax Law, the Social Insurance Act, the Archival Act. Your data may also be stored until the execution of entrustment agreements, as well as for the purpose of establishing, pursuing and/or defending claims.

Your personal data may be entrusted by the Administrator for processing also to external entities supporting the Administrator in its day-to-day operations, in particular:

  • entities providing accounting and HR services to the Administrator, including HR and payroll, accounting and tax services, etc., in particular to the extent necessary to perform accounting or settlement activities;

Information clause Art. 14 GDPR

Dear Sir or Madam, Pursuant to Article 14 of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter “GDPR”), we inform you that:

  1. The Controller of your personal data is: Warszawskie Zakłady Mechaniczne „PZL-WZM”
    w Warszawie S.A. with its seat in Jawczyce (05-850), ul. Piastowska 67, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw, 14th Division of the National Court Register, under the KRS number 0000320810, with a share capital of PLN 20,000,000 (paid in full), NIP 5250000860, REGON 012078978, hereinafter referred to as the Company or the Controller.
  2. The Controller has appointed a Data Protection Officer in the person of Ewa Jewusiak-Andrzejczak.
  3. You may contact the Controller in writing on all matters relating to the processing of personal data and the exercise of your rights in relation to data processing
    to the Company’s address indicated above or via email address: rodo@wuzetem.pl.
  4. Your personal data subject to processing by the Company was obtained directly from our Contractor with whom you are employed or with whom you cooperate or represent. We will process your following personal data: name, business e-mail address or telephone number. As an exception, we may also process your PESEL number.
  5. Your personal data will be processed for the purpose of entering into, executing and settling contracts between the Company and the Contractor you represent (Article 6(1)(b) GDPR) or for whom you work or cooperate. The legal basis for the processing of personal data is also our legitimate interest (Article 6(1)(f) GDPR), which we consider to be, among other things:
    – establishing a business relationship (e.g., submitting an offer or request for proposal),
    – verification of persons authorized to represent the Contractor,
    – activities related to the establishment of the terms of the contract with the Contractor and the facilitation of communication related to its execution, as well as the establishment of persons responsible for the implementation and authorized contacts in the performance of the contract,
    – establishing, asserting and defending claims or rights related to the performance of the contract,
    – maintaining business contacts for the execution of concluded contracts,
    In addition, we may process your personal data (Article 6(1)(c) GDPR) in order for us to fulfill our obligations under the law.
  6. The recipients of your data will be:
    – service providers, including providers of IT, technical and organizational solutions that enable the Company’s management, including entities that provide legal, IT and consulting services to the Controller;
    – authorities and other entities, including public entities, authorized to obtain your personal data under generally applicable laws.
  7. The Controller has no intention of transferring your personal data to a third country
    or international organization.
  8. Your personal data will not be used for purposes other than those for which they were originally collected.
  9. 9. Your personal data will be retained in accordance with the law, i.e. In particular:
    – your personal data will be processed for the period of execution of the concluded contract
    with the Contractor, possibly for the period of assertion and defense of claims or rights related to the
    execution of the contract. After this period, the data will be processed to the extent and for the duration commonly required by law, in particular tax regulations;
  10. You have the right to access your personal data, the right to rectify your personal data, the right to erasure (the so-called “right to be forgotten”), the right to restrict the processing of your personal data, the right to data portability, the right to object to the processing of your personal data, to obtain a copy of your data, the right
    to data portability. At the same time, please be informed that the exercise of some of your rights may be limited due to generally applicable laws, which the Controller is obliged to apply.
  11. If, in your opinion, the Controller’s processing of your personal data violates the law, you have the right to lodge a complaint with the supervisory authority, i.e. the President of the Office for Personal Data Protection.
  12. No automated decisions, including decisions based on profiling, will be made with respect to you.
